COPPA Direct Notice to School Districts

We are providing this Direct Notice Regarding Children’s Privacy as required by law to support your education institution in making a determination about consenting to our collection of Personal Information from your students under age 13. We also encourage our Customers to share this and our Privacy Policy  with parents of students who will be using the Pathful Services to help them better understand our privacy practices. 

Pathful, Inc. Direct Notice Regarding Children’s Privacy

When our educational institution customers decide to use Pathful’s K-16 college, career, and workforce readiness solutions with their students under the age of 13, Pathful relies on an authorized individual from each customer institution to consent to our collection and use of personal information from students under age 13 on behalf of their parents before we collect that information. This consent is included in our contract with the customer, and by executing the contract to obtain the Services, you are granting permission to collect personal information from students under age 13 as described below. 

Personal Information We Intend to Collect Directly From Students Under Age 13:

As students use our Services, we collect Personal Information in the form of assignments, which may include materials such as essays, survey results, resumes, cover letters, and feedback on assignments. 

This information is provided to the educator to facilitate their support of the student.

To the extent that students are permitted by their educational institution to participate in video conferences or other live video or audio sessions with industry professionals (which we refer to as “Live Sessions”), we also collect the video and audio recording, which may include student names, images, voice, and chat history.

We also automatically collect the Internet Protocol address associated with the student’s device, the browser type and version, the operating system of the device, network information and other device-specific information, as well as logs of activity within the Services. We also collect the language used on the device, areas of the Services visited, the pages viewed and the time and duration of the visit. 

The information that we collect automatically is used what the law considers to be our permissible, “internal operations” – such as to help us understand how our Services are used, diagnose technical problems, remember your preferences, improve our Services, and to support the security of the Services (such as helping to prevent fraud and abuse and protecting our computer, software, hardware, and communications systems). Typically, we use this information in the aggregate, in a way that doesn’t identify a specific individual. However, when this information is in a form that identifies an individual, we treat it as Personal Information in accordance with this Privacy Policy.

How We May Use and Share Student Personal Information

We use the student personal information we collect only to support the customer's education purpose, including to provide the Services and provide support for the Services. We don’t use student personal information for commercial purposes. 

We share certain student personal information with companies that assist us in providing the services. This includes companies that provide cloud services for storage of the information, security services to help maintain confidentiality of the information, analytics companies that help us understand how our services are used and to troubleshoot issues. Limited student personal information may also be shared with industry professionals who provide video sessions at the direction of the customer’s educators.

The authorized individual at the Customer institution may, on their own behalf or on behalf of a parent, request to review personal information that is collected from the student under the age of 13, request deletion of any or all such personal information, and instruct Pathful to cease further use or collection of personal information from the student. We retain personal information from live sessions for 30 days. We otherwise delete student personal information within 30 days of receipt of a written request from the customer.
