Services Privacy Policy

Pathful, Inc. (“Pathful,” “us,” “we,” or “our”) owns and operates the K-16 college, career, and workforce readiness solutions (the “Services”) made available to education institutions (“Customers”). This Services Privacy Policy describes how we may collect, use, and disclose Personal Information that we collect from the users during their use of our Services, as well as your rights regarding your Personal Information.

In this Services Privacy Policy, we refer to users of the Services, which typically are educators (including guidance counselors), students, and parents, as well as industry professionals who make their expertise available to Customers. We refer to all users collectively, as “you,” or “your.” When we refer to “Personal Information,” we mean information collected via your use or prospective use of the Services that identifies, describes, or relates to an identified or identifiable individual, or that is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular individual or household.   

By accessing or using the Services, you acknowledge that you have read and understood this Services Privacy Policy. In addition to this Services Privacy Policy, your privacy is further governed by our contract with the Customer (the “Customer Agreement”). 

Personal Information We Collect

In order to create rosters of users who will be accessing our Services, we use the Customer’s existing third-party, single sign-on vendor. The Customer determines the overall scope of Personal Information it will provide directly to us via bulk data uploads and manual direct entry as well as via its third-party vendors. 

Required Information

We collect the following required information: 

  • Student Data:  First and last name, username and password, school name and class information.
  • Educator Data:  First and last name, email address, username and password, school name and class information.
Optional Information

Additionally, we collect the following information provided solely at the Customer district’s discretion: 

Student Data
  • Student Information System (SIS), state, or other unique identifiers
  • Date of birth
  • Grade level
  • Ethnicity
  • Gender
  • Email address
  • Individual Education Plan (IEP) status
  • 504 accommodation status
  • Photo
  • Address
Educator Data
  • Photo
  • Address
Authentication Information

For customers utilizing SSO providers, we also receive: 

  • Authentication token
  • Unique identifier
  • Username and password (set by the SSO provider)
Live Streaming Video Sessions

When Educators or other users participate in live streaming video sessions offered as part of the Services (“Live Sessions”), we collect a recording of the Live Session, which may include audio, video, names, and chat history of all participants. 

SMS Text Messaging

We may ask you to voluntarily provide a telephone number so we can assist you in the provision of the Services. By providing a telephone number to us you are consenting to be contacted by SMS text message. Message and data rates may apply. You may reply STOP to a text message from us to opt out of further messaging. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We do not share text messaging originator opt-in data and consent; this information will not be shared with any third parties other than in the course of providing the Services to you.

Personal Information We Collect Directly From Students

When students use the Services, we collect Personal Information in the form of assignments, which may include materials such as assessments, essays, survey results, resumes, cover letters, and feedback on assignments. This information is provided to the educator to facilitate their support of the student. 

In addition, if the Customer chooses to allow students to access the Services post-graduation, we will collect an email address from the student to facilitate that access. 

As noted above, we also collect a recording of Live Sessions, which may include audio, video, names, and chat history of participating students.

Personal Information We Collect From Industry Professionals

If you are an industry professional who chooses to volunteer to provide webinars or conference calls to educators and their students (a “Presenter”), we will request that you provide us with your first and last name, resume, references, and sufficient information to conduct appropriate background checks, subject to our separate agreement with you.

We will also collect a recording of all sessions provided by Presenters, including audio, video, and any chat history. 

Automatically Collected Information
  1. As you use our Services, we automatically collect certain information from you using various tracking technologies. The information we collect includes the Internet Protocol address associated with your device, your browser type and version, the operating system of your device, settings, unique device identifiers, network information and other device-specific information, as well as logs of your activity within the Services. We also collect the language used on the device, areas of the Services that you visit, the pages viewed and the time and duration of your visit. 

We use this information to help us understand how our Services are used, diagnose technical problems, remember your preferences, improve our Services, and to support the security of the Services (such as helping to prevent fraud and abuse and protecting our computer, software, hardware, and communications systems). When this information is in a form that identifies you as an individual, we treat it as Personal Information in accordance with this Services Privacy Policy.

The technologies we use to collect this information include: 
  • Automated Rostering and SSO Solutions: For Customers using single sign-on vendors, we receive rostering information directly from these vendors on our Customer’s behalf.
  • Cookies: Cookies are small data files sent by a website and stored on your device. Cookies store information that allows us to recognize the browser on return visits and to remember your preferences.
  • Clicktracking: Clicktracking allows us to capture "clickstream data'' about your use of the Services. This includes information about what actions you take in the Services, such as what you see or click on during your visit and how you interact with certain features. This can include information such as the order in which you click on buttons or links on a page, and it allows us to develop insights about how you move through the Services. 
  • Third Party Cookies and Tracking: We use third parties with respect to certain of the Services to help us collect and understand the Automatically Collected Information described above, as well as to personalize the content that you see. Most browsers can be set to detect cookies and let you reject them, but refusing cookies may impact your ability to access the Services and maintain your progress in the Services.

Personal Information We Collect From and About Students: The Family Educational Rights and Privacy Act

In the event that the Customer is subject to the Family Educational Rights and Privacy Act (“FERPA”), they are asked to agree in a contract with Pathful to designate us as a “school official” with a “legitimate educational interest” in providing the Services as the terms are used in FERPA §§ 99.31(a)(1). Pathful remains under the direct control of the Customer with respect to the use and maintenance of FERPA-protected “education records” and uses student Personal Information only as set forth in our agreement with the education Customer and in compliance with applicable law.  

Personal Information We Collect From Children Under Age 13: The Children’s Online Privacy Protection Act

If a Customer chooses to use our Services with students under the age of 13, the Customer contractually agrees to act in lieu of parents in providing us with consent prior to our collection of Personal Information from those under age 13.  We otherwise comply with our direct obligations for protecting that Personal Information. If we learn that we have inadvertently collected such Personal Information without the necessary consent, we will take steps to promptly delete it. 

Parent Rights

Parents of children under age 13 who are using the Services should contact the Customer if they wish to review or request deletion of their child’s Personal Information, or request that we make no further contact with their child. We will work with the Customer as necessary to facilitate that or any related rights requests.

How We May Use Personal Information We Collect

We do not sell or rent your Personal Information, and we do not use your Personal Information for advertising purposes.

  1. Generally, we use your Personal Information to provide the Services, including to create accounts for educators and students, and as described below:
  • To provide and maintain the Services, including to create and manage login credentials to authenticate users of the Services, allow teachers to create activity plans and assignments for each student, allow students to participate in activities assigned by an educator; provide educators with student progress reports and student feedback related to the assignments, to create educator and Presenter profiles and to provide access to content provided by Presenters.
  • To match educators with Presenters when an educator expresses interest in scheduling a video conference session, including a Live Session, for their students, including to allow Presenters to view educator profiles and for educators to view Presenter profiles.
  • To deliver Presenter webinars, in which case educator and student participant information, such as name, video, audio, or chat if the educator has enabled such features, may be shared with the Presenter and other participants.
  • To allow educators to contact organizations, including prospective employers, education institutions, and scholarship providers on behalf of their students.
  • To provide customer support, including via phone and email, to help maintain the security of our Services, and to communicate with you regarding the Services and solicit your feedback on the Services.
  • As applicable, to process your payments in connection with the Services.
  • In the event of a reorganization, merger, sale, assignment, bankruptcy, or similar business change, in which case we may need to transfer your Personal Information to that re-organized entity or new owner after the sale or reorganization for them to use in accordance with this Services Privacy Policy.
  • In the event of an investigation, during which we may share your Personal Information with entities assisting us, or as may be required by applicable law in response to a known or suspected violation of your Customer Agreement, terms of use, fraud prevention, or other unlawful use of our Services.
  • We may use and disclose your Personal Information as necessary to protect our rights or the rights and safety of our users, or as necessary in the event of a court order, regulatory inquiry or other lawful request; provided, that unless legally prohibited, we will direct any such request to you or notify you before responding unless to do so would prejudice the prevention or detection of a crime.     
  • To provide existing Customers with marketing materials, including updates and offers about our Services. At any time, you may unsubscribe or opt-out of further email communications by clicking on the link labeled “unsubscribe” or “manage preferences” available at the bottom of each email or by contacting us at support@pathful.com.   

Where We Share Your Personal Information

To assist us in delivering and maintaining our Services, including to provide certain features, it is sometimes necessary to share certain Personal Information with third-party providers. These services and features include data hosting, maintenance, security, analytics, content delivery, email communication (not for marketing purposes if you have opted out of such communications), and video players. This list of third-party service providers who may have access to certain Personal Information in support of our delivery of the Services is available here.

In addition, Presenters and educators interested in connecting to request creation or scheduling of video sessions will be able to access each other’s profiles. 

When an educator schedules a video session with a Presenter, student names, images, and comments may be available to the Presenter during the video session. Presenters are subject to non-disclosure agreements, and video sessions are attended by a Pathful staff member or a Customer representative.

Third Party Links

Our Services may contain links to third party websites. The fact that we link to a website is not an endorsement of that website and does not suggest that we are affiliated with that website. We do not control third party websites or their privacy practices and, by accessing those websites, you acknowledge that you are using and relying upon them at your own risk. Those websites may place their own tracking technologies on your device and may have different rules regarding what information they collect, and how they use and disclose that information. We encourage you to read the privacy policy and terms of any website that you visit.

In addition, Customers may choose to provide their students with links to third-party websites via the Services, such as links to internship or scholarship opportunities, after-school activities, or other services. We do not control, and are not responsible for, any facets of these third-party links, including the content, privacy practices, or appropriateness of those third-party websites.

Security

We use industry standard physical, administrative, and technical safeguards to help protect the confidentiality, security, and integrity of your Personal Information. However, the Internet is not perfectly secure, and we are not responsible for security breaches not reasonably foreseeable or reasonably within our control.

If you know or suspect a security incident, including if you believe that your access credentials have been compromised, please contact us promptly at support@pathful.com.

How Long We Keep Your Personal Information

We retain recordings of Live Sessions for 180 days. We delete student and other user Personal Information within 30 days of a written request from the Customer. 

We may create and retain deidentified data for use for lawfully permissible purposes.

Opt-Out Policy

We may send Customers emails with information about our products and services that we believe may be of interest. You may opt out of receiving these emails by clicking on the “unsubscribe” or “manage preferences” link that appears on the bottom of each email we send, or by contacting us at support@pathful.com. Note that even if you have opted out of marketing emails, we may still send you emails related to the Services.

We do not send marketing emails to students.

Your Rights

In addition to the rights of parents regarding the Personal Information of children under the age of 13 as described above, certain US state laws provide their residents with certain rights related to their Personal Information. These rights may include:

  • Right to Know and Access Personal Information: You may access Personal Information we maintain about you and request to receive it in a machine-readable copy to allow you to transfer it to another party without hindrance. 
  • Right of Correction: You have the right to correct inaccuracies in the Personal Information we maintain about you.
  • Deletion of Personal Information: You may ask us to delete the Personal Information we maintain about you by using the methods provided below.
  • Right to Portability.  The right to move, copy, or transfer personal data.
  • Right to Restrict Processing.  The right to restrict or limit our use, disclosure, or processing of personal data (this may limit your ability to use the Services).

We do not engage in activities that would be considered a “sale” of Personal Information under US state privacy laws.

To help prevent unauthorized access to your Personal Information, we are required by law to verify your identity before fulfilling certain rights requests. Please also note that the rights above are subject to certain exemptions. As a result, depending on the scope and nature of the requests and applicable law, we may not be able to grant the rights in whole or in part. Where we are unable to fulfill your request in whole or in part, we will explain that in our response to you.

When authorized by law, you may be allowed to use an authorized agent to exercise the above privacy rights on your behalf. Any authorized agent must be able to demonstrate the necessary authorization and access to act on behalf of another individual. 

How To Exercise Your Rights

You may exercise your rights by making a request to the education institution Customer or to us at the contact information below. We will work with them as necessary to respond to your request.  We will comply with your rights within the time frame required by applicable law. We don’t discriminate or otherwise penalize anyone for exercising their rights under this Services Privacy Policy.

Supplemental Notice to California Residents

If you are a California resident, you may have additional rights described in the California Supplement available at www.pathful.com/website-privacy-ca-supplement, which is incorporated by reference into this Services Privacy Policy. 

Updates to this Services Privacy Policy

We may make changes to this Services Privacy Policy if required by changes in applicable law. If we make material changes to this Services Privacy Policy due to a change in law, we will send notice to the Customer and request Customer consent if required by law. The “last updated” note at the top of this policy indicates when it was last revised.
